Finsec Dialogue on SEBI Consultation Paper on Investment Advisers Regulations (January 2018)

We are pleased to announce the twenty-fourth edition of Finsec Dialogue on “SEBI Consultation Paper on Investment Advisers Regulations”.

Under the existing framework, no person can provide advice on securities and investment products without obtaining registration under the SEBI (Investment Advisers) Regulations, 2013. The IA Regulations exempts persons such as, stock brokers and distributors, from obtaining registration for rendering such advice incidental to their primary activity. In order to minimize the conflict between its various activities and ensure maximum fairness to the investors, SEBI had previously circulated two consultation papers proposing changes in the IA Regulations. On January 2, it has published a third such paper with more stringent proposals for regulating the persons who have both advisory and distribution businesses. Some of these suggestions are: restriction on the immediate relatives of an individual IA from undertaking distribution business, and prohibiting subsidiary / associate / holding company of an IA from providing distribution services.

In this edition of Finsec Dialogue, we will provide an overview of the proposals contained in the consultation paper and critically examine its impact on various market participants.

About the event:

Finsec Dialogue is a monthly event where we discuss topical issues in the field of financial regulation, including securities and investment laws. Participants would be able to connect over a telephonic conference call. Discussions would be led by a team of two speakers from Finsec Law Advisors. The speakers would provide the necessary background, lay down the conceptual framework, highlight the key issues involved and discuss implications for 15-20 minutes. This would be followed by an interactive session between the speakers and the participants.
